    • Should a client mislead or create duplicate accounts under varying details, taking advantage of purchasing the Introductory Offer more than once, any classes attended/booked on duplicate/subsequent offers will be charged at a Drop-In rate.​

  • Valid for 90 days (approx. 3 months) from the date of purchase.

  • Billed in advance.

20 Class Pass

  • Valid for 150 days (approx. 5 months) from the date of purchase.

  • Billed in advance.

  • Valid for 10 months from the date of purchase.

IN-STUDIO MEMBERSHIPS - ALL LOCATIONS 

​

12-Month Memberships (52 Weeks) (2 Class/Wk, 3 Class/Wk, UNLIMITED)

  • Commencement from payment date.

  • Billed weekly in advance.

  • All memberships 12-month contract.

  • 14 days’ notice must be given for any pauses, with a maximum of 60 day’s pause per contract term. This notice must be requested in-writing, sent to info@coreculture.com.au. Notice period will begin from the date email is sent to the correct address.

  • All membership credits maintain a 7-day validity and will not be credited to the following week if unused.

  • Pauses are only available when all payments are up-to-date and there are no outstanding fees (Membership fees, no-show fees, outstanding debt) on the account at the time of request.

  • Auto Renew for new term (unless provided 30 days prior to agreement renewal date).

  • The client remains under the same agreement until said agreement has been terminated. A new agreement will not be issued in the event the client continues after the initial 12-month period. The same agreement initially signed will remain in-place until terminated, including all terms.

  • Contract cannot be terminated within the initial contractual period (12-months) due to a change of mind. 

  • Following the initial 12 months, a client may terminate their Membership with 60 days’ notice. This notice must be submitted in-writing to info@coreculture.com.au. Following the termination request, the client will be required to book a 15-minute meeting with the Core Culture team to process the cancellation.

    • The 60-day notice period will commence from the date said meeting is booked.

    • The termination will be implemented on the system following the meeting, acknowledging the 60-day period from the time of booking.

    • Meeting must be booked within a reasonable timeframe (as deemed by the owner), prior to the 60-day notice concludes.

    • Should the client fail to show for their booked meeting without explanation or fail to make fair/reasonable efforts to cooperate with Core Culture to facilitate said meeting (deemed by the owner), the contract will remain in-place until a meeting is re-booked/booked. The 60-day period will restart/start in this event.

    • Terminations are only available when all payments are up-to-date and there are no outstanding fees (Membership fees, no-show fees, outstanding debt) on the account at the time of request

  • In the event of moving a reasonable distance from the studio/s (as deemed by the ‘owner’), an ‘Early Termination’ may occur within the minimum term. A termination fee of 4 weeks’ membership payment will be payable, and the 30-day notice period applies. Proof of moving a reasonable distance from one’s ‘Home Studio’ must be given upon applying.

    • Early terminations are only available when all payments are up-to-date and there are no outstanding fees (Membership fees, no-show fees, outstanding debt) on the account at the time of request.

    • Early Terminations will only be processed once the payable fee (4 weeks’ membership fee) is paid in-full via the Core Culture CMR (Hapana platform). The 30-day notice period will commence from the dated said payment is made.

    • Clients are able to attend the studio according the their membership terms during the 30-day notice period.

    • Any additional benefits will be deactivated/removed once client has finished the 30-day notice period. Including:

      • Any un-used Core Culture The Label Gift Cards

      • Perks Program

      • High Society Program

      • The Core Culture Residence Access

      • Complimentary Access to Core Culture Wellness events that occur after agreement is terminated. Any events that occur after agreement is terminated will be payable in-full, should the client still wish to attend.

ONLINE MEMBERSHIPS - THE CORE CULTURE RESIDENCE

​1-Month Membership ​

  • Access for 1 Calendar month from payment date.

  • Commencement from payment date.

  • Billed in Advance.

  • 1-month minimum. 

  • Auto-Renews unless cancelled by the user via the Core Culture platform.

3-Month Membership​

  • 3 Calendar months from payment date.

  • Commencement from day after payment date.

  • Billed monthly in advance.

  • ​3-month minimum. 

  • Auto-Renews unless cancelled by the user via the Core Culture platform.

12-Month Membership​

  • Access for 12 Calendar months from payment date.

  • Commencement from day after payment date.

  • Billed monthly in advance.

  • ​12-month minimum. 

  • Auto-Renews unless cancelled by the user via the Core Culture platform.

BLACK FRIDAY 2023 - GIFT WITH PURCHASE TERMS​

​

  • 'Black Friday packages that are purchased on the 25th of November 2023 via the Shopify website will fall under the "BLACK FRIDAY 2023 - GIFT WITH PURCHASE TERMS​". 

  • 10-Pack + 3 Pack Gift with Purchase

    • 10-pack will activate on the date of purchase (once attached to the purchaser's account). ​

    • 10-pack will maintain the same terms as the 10-pack outlined above 

    • 3-Pack Gift with Purchase will have a validity of 5 weeks. 

    • All packages and Gift with Purchase 'Gift Cards' are valid to be used across all CC locations. 

    • The 3-Pass Gift Card (Gift with Purchase) will have a validity of 5 weeks from activation. The Gift Card must be activated prior to March 25th, 2024. 

    • Gift with Purchase 'Gift Cards' and Class packages cannot be combined, making one larger package. Due to the differing validities, they must remain separate, honouring the Term's and Conditions. 

    • Non-transferable.

    • Non-refundable.

    • Not to be shared between multiple clients.

    • Validity is unable to be extended on either package.

  • 20-Pack + 3 Pack Gift with Purchase

    • 20-pack will activate on the date of purchase (once attached to the purchaser's account). ​

    • 20-pack will maintain the same terms as the 10-pack outlined above 

    • 6-Pack Gift with Purchase will have a validity of 8 weeks. 

    • All packages and Gift with Purchase 'Gift Cards' are valid to be used across all CC locations. 

    • The 6-Pass Gift Card (Gift with Purchase) will have a validity of 8 weeks from activation. The Gift Card must be activated prior to March 25th, 2024. 

    • Gift with Purchase 'Gift Cards' and Class packages cannot be combined, making one larger package. Due to the differing validities, they must remain seperate, honouring the Term's and Conditions.

CORE CULTURE IGNITE PURCHASE TERMS

​

52 Week Memberships (Wk, 3 Class/Wk, UNLIMITED)

  • Commencement is from payment date or the day following the purchaser's current agreement term ends.

  • Billed yearly in advance. No renewal periods. 

  • 52-week agreement term.

  • 14 day’s notice must be given for any pauses, with a maximum of 10 weeks pause per contract term. 

  • Pauses are only available when all payments are up-to-date and there are no outstanding fees (Membership fees, no-show fees, outstanding debt) on the account at the time of request.

  • The client remains under the same agreement until said agreement has been terminated. 

  • Contract cannot be terminated within the contractual period due to a change of mind, moving, or other circumstances.

  • Membership cannot be transferred. 

  • Membership is non-refundable (by cash nor account credits), and not able to be cancelled at any time.

CORE CULTURE 6-WEEK CHALLENGE PURCHASE TERMS

​

The client is entering a 6-Week (42 Day) Agreement with Core Culture Au that will be guided in exercise routine, coaching towards nutrition, and supplementation. All information regarding ailments, injuries, illness, medicines, treatments, allergies, or other relevant medical and health history has been disclosed prior to starting this program. To participate in this program the client acknowledges that they are in good health and do not have any underlying conditions, ailments, or allergies that will prevent them from participating in this program. If any underlying conditions are present, the client has fully disclosed all of those prior to starting. 

​

The client is placing a financial deposit of $899 AUD to reserve their spot in the program. Upon completion of the agreement, their deposit will be credited towards a continuation program. All sales are final and non-refundable and may only be transferred to select additional services upon completion of the program. Challenge deposits can only be applied to 12-month membership agreements, and memberships must be confirmed within 48 hours of the client's challenge program ending. Credit cannot be applied to packages or class credits.

  • Commencement is from the first Monday following payment date - unless otherwise arranged between both parties.

  • Billed 6-weeks in advance. No renewal periods. 

  • 6-week agreement term.

  • Pauses are not available.

  • 6-week challenge offers 3 in-studio classes a week

  • Contract cannot be terminated within the contractual period due to a change of mind, moving, or other circumstances.

  • Participation cannot be transferred. 

  • Membership is non-refundable (by cash nor account credits), and all sales are final.

  • Challenge price can be applied to an ongoing 12-month membership. Ongoing membership must be confirmed within 48 hours of 6-week challenge ending.

    • Credit will not be applied to memberships arranged after 48-hour period lapses.

    • Credited membership rate will not renew in the following year.

    • Membership will follow the standard 12-month agreement terms.

  • Offer is only available to New Core Culture clients, and at the discretion of the owner.

CORE CULTURE POLICIES, PROCEDURE, TERMS AND CONDITIONS

In-Studio Policies

​

The client must check-in via the ‘iPad’ located on the front desk, upon arrival. It is the client’s responsibility to ensure they check-in correctly upon arrival, to confirm they have attended. If you do not check-in upon your arrival, it is assumed that you have not attended the class and No-Show Fees will apply.

You must attend/have the intention to attend the class if you have checked in. If you check-in without the intention to attend (i.e., you leave the studio after checking-in to avoid a no-show fee), it is at the Owner’s Discretion to charge a no-show fee if it is deemed a ‘check-in’ was not in good-faith.  

 

Terms:

  • Late Cancel – A class cancellation that is made within 4 hours of the class start time.

  • No-Show – One is booked-in to a class, does not cancel their booking via the booking platform (app or via the CC website), and fails to attend the class.

Should you late cancel your class, the client is deemed to have attended the class and this will be reflected on the client’s account accordingly. A booked class must be cancelled in the Hapana Booking System (via the Core Culture Au App, or via the Website login) at least 4 hours prior to the commencement of the class. Core Culture may, at its absolute discretion accept a cancellation by email or phone. Core Culture may, at its absolute discretion accept a cancellation within the 4-hour timeframe.

Should you fail to attend your booked class, the client is deemed to have attended the class and this will be reflected on the client’s account accordingly and a $15 No-Show Fee will be applied to your saved payment method, via our payment processing platform.

By purchasing your class passes, you acknowledge that No-Show fees will be charged to your saved payment method, when applicable. You will be sent an email receipt of your payment once it has been processed. No-Show Fees may be processed by Core Culture up-to 14 days after the class date. If there is no valid payment method saved to your Core Culture Account and a No-Show Fee is to be applied, an invoice will be sent via email. This invoice is to be paid within 3 business days, or late fees will apply. This policy is put in place to encourage clients to cancel if they won’t be attending, to allow other clients to take the spot. If a class is cancelled prior to the start of class, no fee will be charged.

Late Arrivals

​

Should a client be more than 3 minutes after the class start time (as per the public/official timetable) their spot may be given to a walk-in client. In this instance, the client that has arrived late will be charged accordingly, as a no-show. This policy is in-place to ensure prompt arrival and as minimal disruption to class for other members as possible.

Classes will not accept attendees more than 7 minutes after the class start-time, regardless of whether there are free reformers or not. This policy is in-place to avoid injury and to minimise disruption to the rest of the attendees. Warm-ups are an important part of the Core Culture method and help to keep our client’s safe. By missing the entire warm-up, we cannot do our best to keep you safe. In the instance a client arrives more than 7 minutes late and are unable to participate, they will be deemed a ‘No-Show’, and will be charged accordingly.

Refund Policy 

Whilst Core Culture aims to provide a regular and flexible class schedule, the number, type and frequency of classes is subject to change without notice.

Unless otherwise agreed, Core Culture AU does not offer refunds on service's (classes). Class Days, Times and Teachers are offered at the absolute discretion of Core Culture. Classes may be cancelled or re-scheduled at the absolute discretion of Core Culture. You will not be entitled to any compensation where classes are re-scheduled.


 

Liability Waiver

In proceeding with the purchase of your class passes/membership, you agree that Core Culture is in no way responsible for the safekeeping of my personal belongings while I attend class.

I understand that Core Culture AU classes are physically strenuous, and I voluntarily participate in them with full knowledge that there is a risk of personal injury, property loss, and/or death.

By agreeing to these terms and conditions, I acknowledge that such risks include but are not limited to heart attack, stroke, broken bones, sprains to ankles or wrists, muscle or tendon injury, back or neck injury, shoulder injury, knee injury, tendinitis, shin splints or other injury associated with high-intensity training.

I acknowledge that I have considered these risks and made an informed decision to participate in Core Culture classes regardless of the risks. I have been given the opportunity to address any concerns I may have in relation to the risk of injury due to participating in Core Culture classes.

I agree to disclose to Core Culture and any person conducting a class I participate in any pre-existing condition I experience which may be exacerbated by the exercises performed in the classes before commencing any class.

You acknowledge Core Culture may refuse to allow you to participate in a class if they deem it unsafe to other participants or me. Core Culture often films or photographs the studio, so you may appear in the background. I agree by signing this agreement that I allow Core Culture to use my image in social media, promotional, and other business-related material without any payment or otherwise by Core Culture.

If a provision or part thereof of this agreement is illegal, invalid, unenforceable, or void in a jurisdiction, it is severed for that jurisdiction. The remainder of this agreement has full force and effect, and the validity or enforceability of that agreement provision in any other jurisdiction is not affected.

Purchase Policy 

​

Depending on the type of membership/pack/credit being utilised to attend a class, purchases policies will differ. Please refer to terms and conditions, specific to different purchasing options. 

Across all Core Culture AU classes, payment (in the form of monetary value or a pre-purchased studio credit) must be received in full prior to the commencement of class. 

Credits and/or memberships are not transferable to others, or for cash.

The prices of Core Culture Memberships, Packs, Classes and Merchandise may change from time to time without Notice. These changes will be reflected on the Website – www.coreculture.com.au and on the Core Culture Booking platform (mobile app and website) accordingly.

Member Conduct and Responsibilities

​

Core Culture may, at its absolute discretion and without warning, cancel and refund any credits to a member for any of the following reasons:

  • threaten or harass others;

  • tamper with, damage or misuse studio equipment;

  • act in a reckless or dangerous manner;

  • wear clothes with offensive images or inappropriate advertising;

  • use illegal or performance-enhancing drugs;

  • interfere with the smooth running of a class;

  • infringe on any intellectual property rights or trademarks of Core Culture;

  • fail to disclose any injury or other issue which would prevent a member from participating safely in classes.

​

Core Culture may, at its absolute discretion refuse a client from participating in a class if:

  • the client has an infection, contagious illness or physical ailments, such as an open cut or sore;

  • there is any other risk, however small, to other members and guests.

  • In these circumstances Core Culture may choose to continue to refuse a member from participating in a class until:

  • a doctor agrees in writing that you are fit to exercise

  • proof is provided that you have received medical advice on an appropriate exercise program.

Referral Reward

​

  • Referral Form Submission

    • To participate in the Core Culture Referral Program, the referring client must complete and submit the official referral form to qualify for a referral bonus.

    • This ensures the referral can be properly tracked and credited.

  • Eligibility of Referrer

    • The referring client must be an active Core Culture client at the time the referral form is submitted.

  • Eligible Referees

    • Only new clients to Core Culture are eligible as referees.

    • Referrals cannot include current or previous Core Culture clients.

  • Referral Form Timing

    • The referral form must be completed within 14 days of the referee’s trial activation (applicable to any trial type) to qualify for the referral bonus.

  • Referral Bonus Activation

    • A referral bonus will be credited to the referrer’s Core Culture account once the referee successfully converts to an eligible membership or purchases a class package of 10, 12, 20, 50, or 100 credits.

  • Bonus Credit Details

    • The referral bonus is valued at $60 AUD (including GST), unless otherwise specified during promotional periods.

    • This bonus is redeemable solely for Core Culture class credit packages or membership payments.

    • The referral bonus cannot be redeemed for cash, nor can it be transferred to another person or account.

  • Non-Eligible Activities

    • Self-referrals or any misuse of the referral program, including the creation of duplicate accounts or false referrals, are strictly prohibited.

    • Any detected abuse of the program will result in the immediate deduction of all referral credits from the referrer’s account.

    • Additionally, any referral bonuses that have already been redeemed will be payable by the client with a 10% loading fee.

  • Expiry of Referral Bonus

    • Referral bonuses must be used within six (6) months of issuance.

    • Any unclaimed bonuses will be forfeited after this period.

  • Program Changes and Notification

    • Core Culture reserves the right to modify or discontinue the Referral Program at its discretion.

    • Core Culture will make reasonable efforts to notify participants of significant changes to the program.

By participating in the Core Culture Referral Program, clients agree to these terms and conditions. Core Culture reserves the right to enforce all terms and conditions at its sole discretion.

PAYMENT TERMS AND CONDITIONS

​

Ongoing Memberships

​

You pay fees for ongoing membership fees in advance by direct debit from a bank account or credit card. You can pay your membership fees as far in advance as you like, up to the legal time limits (12 months). However, you still need to provide your account details for when your advance payments end. Should there be any arrears in payments, you authorise Core Culture to debit the outstanding balance in order to bring the account up to date. You will be responsible for any fees and charges associated with declined payments.

Paying by Direct Debit

 

Your membership fees will be debited from your nominated account at the agreed payment frequency, as set out in your membership agreement. You request and authorise us to arrange for any amount we may debit or charge you to be debited by a third-party direct debit billing service provider from your account subject to their terms and conditions.

All payments (memberships and class packages) will incur fees from our External Payment provider, EZYPAY. If a payment declines, you will be sent an alert email and/or SMS (unless client has opted-out of all communications from Core Culture). Core Culture’s CRM system will periodically re-try this payment without further notice, up-to five times. Each payment attempt will incur a processing fee, which will be applied to the outstanding invoicing until invoice has settled. Core Culture is not liable to cover any of these fees at any stage, nor required to alert of multiple payment processing attempts. Core Culture will not attempt to settle a payment more than once (1) in a 24-hour period.

​YOUR RESPONSIBILITIES ​

​

You must make sure:

  • ​Your account can accept direct debits (your financial institution can confirm this) • there is enough money in your account on the payment day and the next 5 days;

  • you tell us if you are transferring or closing your account, at least 48 hours before your next direct debit;

  • you tell us about any changes to your credit card, such as its expiry date or number, at least 48 hours before your next direct debit.

 

Please notify Core Culture and your financial institution if you want to change or stop your direct debits.

​Memberships

​

​Should a client need to pause their membership due to sickness or injury, a medical certificate is to be sent to info@coreculture.com.au, confirming the required dates for the account suspension. Once verified, the account will be placed on-pause for the required period. Should the pause request exceed 60 days of medical leave (not inc. as other suspension-time), a termination or extended pause will be negotiated, at the owner’s discretion. Fees and notice periods will apply.

Class Pass

 

In the event a Class Pass booking is made and is a no-show, the client will be invoiced or automatically debited the cost of a Core Culture Casual class - $49. Should the client not have their billing details attached and therefore the payment is not automatically deducted, and invoice will be sent. This invoice is payable within 7-days follow issue. Should the invoice remain unpaid, an additional $5 a day will be charged until paid.

 

A late cancel (within 4 hours of the booked start-time) will incur a Drop-In Fee of $49. Should the client not have their billing details attached and therefore the payment is not automatically deducted, and invoice will be sent. This invoice is payable within 7-days follow issue. Should the invoice remain unpaid, an additional $5 a day will be charged until paid.

 

The Class Pass “special” from January of 2024 is valid for one membership agreement. Prices are not renewable.

Agreement

By signing this agreement, you are agreeing to the above Terms and Conditions, acknowledging you understand (but not limited to):

  • The conditions of entry/participation

  •  The terms of your membership, package and/or purchase, including, but not limited to: 

    • ​Validity of Membership or Package

    • Agreement Renewal Terms

    • Eligibility and Terms to pause memberships

    • How and when no-show fees are charged

    • It is the client’s responsibility to check-in upon arrival

    • Fees associated with multiple payment attempts

    • Memberships and Session Packages cannot be transferred, refunded, or sold for cash.

    • All sales are final

    • Session Packages cannot be paused, nor validity extended.
